  • The police want to talk to me, what should I do? Call a lawyer. Chances are you will be arrested.   • Now that I have been arrested will I have a criminal record ? No! Anyone can be arrested at anytime for anything. What determines whether you have a criminal conviction or not is how the case is resolved. You can only be convicted of crime in one of two ways; plead guilty to a crime or get convicted after trial. As long as the case is not resolved it is “open” and not a conviction, regardless of the charges.   • If I have a conviction can I get it expunged ? No. Unless you were adjudicated a youthful offender at the time of sentencing, If you were convicted of a crime, New York does not currently provide for a way to expunge criminal convictions. However, under certain circumstances a criminal conviction may be sealed.   • Will I lose my job if I get a criminal conviction ? Depends. A felony conviction can be a basis for termination or not being hired. Very often a misdemeanor or violation will not be such and impediment. The best practice is to speak with your employer before taking a plea to determine the consequences, if any.   • What happens if I am arrested at the airport? Queens county is the only county in New York State with two major airports. As a result, if someone is arrested at JFK or LaGuardia airport, the case is very often prosecuted in Queens County Criminal or Supreme Court, Located in Kew Gardens, New York. Cases from the airport range from carrying illegal weapons or drugs to having a warrant when entering the country. Sometimes, clients are arrested for items that they don’t know are illegal (such as a firearm which is legally licensed in another state but not New York) or unaware that they possess.
